Couple of questions folks:
1. Should H1 B Job and GC Job be related? I am going for an H1 B extension based on approved I 140.
2. Can we consider Software Quality engineer on H1B and Software engineer on GC related?
The NAICS occupational codes for
Software Quality Engineer is 541511
Software Engnieer is 541710
Can we consider them related for AC 21 purpose. I so not have the approved labor or I 140.
3. Currently am on H1 which is going to expire next month with my current employer and had my GC filed as a software engineer. I am planning to move over to the client where right now am working as a contractor. I am being offered a position as Software Quality engineer.
Now, do I use the H1 extension and go on to the client or use EAD? If I go onto the client on H1 extension, what happens to the GC process and my EAD?
When I leave the company and if the current employer withdraws the I 140, am I ok?

Hi All,
Have few questions on canadian immigration. I am eligible for AINP H1-B program and am planning to go for it...
1. I am married and have a kid and are staying in India right now. There is a section on AINP 009 form which asks for spouse's and kid's signature as well. So please let me know if I can submit the application AINP 009 form now without my their signature's as they are not with me in USA? or is it mandatory to have their signature's (it
would take couple of weeks for me to get it signed if required). Please advise.
2. Also on CIC application family details form it asks for brothers/sisters addresses. Does complete address need to be mentioned or just city/town and country suffice?
3. Will there be any interview for PNP programs i.e. once the province sponsers me then I will need to apply to CIC..right? Will I be called for any interview for final decision of PR?
4. My wife is going to join me in US for few months and will go back to India to take care of parents (health issues). My question is say when she goes back and is in India and if I will be called for PR interview along with them(i.e. at final stage when called for) and for some reason she wont be able to come back for interview
a. Is it possible for just me to go for the interview and let them know that my family has gone back for some reason. Or is it mandatory for the whole family to go for the interview?

You can get quite far using just Blend, but you probably want to use Visual Studio for the coding and debugging features that Blend doesn't have.

Yeah, the horizontal shot had no sky that wasn't gray - I took many. Also the left side of the bridge has some maintenance going on and looks awful (tarps & scaffolds). I'll work it over some more in PS. Thanks for the feedback :)

Hi,
I have a valid H4 stamping till Sept 2010. I got my H1B approved last year(2009) and COS from H4 to H1 approved. My H1B was effective October 1, 2009. Due to recession, I still have not been able to find a job. Now I want to change my status back to H4.
As I have a valid H4 stamping on my passport, can I travel across the border to Mexico, surrender my H1B I94 and reenter the US with a new H4 I94? Is that possible? Can that be done on the same day? Or should I apply for a COS - Form I539 and get it done here?
Please respond at the earliest.

Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?
Firstly, very sorry for your situation. Seems to be very tricky. I am no lawyer so take my .2 cents with a pinch of salt. I think you are intertwining two separate issues. FMLA may protect you during maternity leave (you need to read the act to see if you qualify) BUT USCIS not approving your petition has nothing to do with your pregnancy neither does your employer. Your employer can terminate you on the basis of non-approval of your H1 not that he is doing because of your pregnancy.

I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.
Please advice me.

As per my knowledge you do not need a transit visa for Dubai and Abu Dhabi. I traveled to India recently through Abu Dhabi and did not need one.

I recently changed job. My H1 transfer is not complete yet. Now I have received a very good offer from a different company. Can I transfer my H1 to this company now?

Yes, you can transfer to any employer and any number of times. At one point, I had 3 approved H1b, but as rule says, I could work only for one at a time :)
All the H1B's are valid till employer revokes it or it expires on its own.
The only danger I see in your case is continuous H1 status. If your current employerB goes ahead and cancels H1 petition, you would have worked illegally for the period of time you were with employerB. That can cause problem in your employerC h1 filling and/or future I-485 filling.
Even if employeeB cancels your petition but employerA hasn't cancel your h1 and it has not expired, then you will not be considered out of status, but you will be considered the one who have worked 'illegally'. This situation might give you h1 approval with employerC, but will have implications in 485 application.
Its better to wait till you get approval notice for employerB and then switch to employerC based on employerB's approval notice.
