Hey guys,
I work in a MNC, my I-140 was filed on July 16th 2007 and is still pending and they r filing my I-485 and my wife's I-485 (as dependant).
But now I came to know about my wife's labor application has been approved and they want to file my wife's I-140 and I-485 concurrently, so can I file another I-485 through my wife's employer for my wife as primary and me being dependant to my wife.
I know this question must be asked a lot of times but does anybody has done it or not done it, please share your experiences.

Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Usually How many days it will take under premium processing? Because my OPT EXPIRES ON DEC 27.

I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?
Please let me know.
You are correct, you have been accumulation illegal stay since your i-94 expiration, when did it actually expire? if it is more than 180 days you better see a good immi attorney!
If you have i-485 pending, then your status is AOS pending since i-94 expiration and is legal.

Extension = from the time requested = for example 4/1/2008 to...no more than 3 years. 3 years is the max time requested. So, if you company requests from 4/1/2008, it should state until 4/1/2011.

Guys,
If you are accessing that from work then probably you are prohibited to see that (Through proxy and/or firewall and/or websense). I can not see that either through IE or firefox from work and could see it well from home through both browsers.

Right - You will have to wait to apply for 485. You can do so only once your Priority DAte is current on the VISA Bulletin.
You can file for i-140 though.......I guess you have a long wait to file 485 and EAD/AP

We asked for people to come forward to transcribe the calls. We do not have anyone. I am sure a lot of people waiting for EADs for their spouses will be having well qualified spouses who can volunteer their time. We have lawyers available to be on calls, but people do not even send questions on time when we announce. We organize calls on weekends, and only few people show up. However we get thousands to show up on tracker threads everyday.
We are doing this as a free service to the community. If people do not value it and help us, they can get their own own lawyers and get paid consultation.
We will not be posting recording for people who do not even want to give us a minute and complete their profile so that we can contact them. The service may also be discontinued if members do not see any value in it.

Hello Friends :
I recd. an email from my attorney this evening stating that "We have mailed you the FOIA request for your and your spouse's signature."
This doesnt make any sense to me, as to what does FOIA mean to start with. So I emailed them back asking, what does it mean and is it something to do like RFE towards my AOS papers filed on 2nd July,2007 (no checks cashed yet, no info in system yet).
My Attorney replied back stating that - "We have filed for full copies of your petitions to be sent to us. The FOIA will allow us to obtain a copy to check the integrity of the filing for our records. Looks like, it will be several years before these I-485 petitions are actually reviewed by the Service unless we see a change in the law. ."
What does this all mean? I am so confused....

Hello All,
For the Visitors Visa(for parents), can a photocopy of Pay-check's be sufficient. Since the last few pay-rolls, my employer is giving everybody a photocopy of the Pay-check from Pay-chex Inc.To reduce costs of printing and mailing the Pay-checks, My employer is asking Pay-chex Inc to email the Bi-weekly pay-rolls of everybody.
Wondering if the US Embassy in India would create an issue by not bringing the original Pay-stubs.

Stick with your wifes country dates. The dates in India wont be stable for long.
I requested(May 02nd) them to approve my case using "Cross-Chargeability", since my wife was born in non-retro country. But from June 01st, my PD (India) also becomes current. I really don't know what to do now?
