Hi, I have fallen in love with a lady from Nicaragua. She has been in the US for 5 years illegally living under a common law marriage to a man with legal US residence. I am a US citizen, born in the US, and I want to marry her and get her legal. There are two points you should know. She has a daughter with the man she was living with who was born in the US almost 3 years ago. She also has a son who is 13 still living in Nicaragua and I want to bring him here to live with us also. How can I get her legal and bring her son here to live with us? We are deeply in love and a separation while she goes back to try to make this happen is out of the question for two reasons, one her ex husband will not allow his daughter to leave the country, and two because I do not want to live without her for that long. Is there any way for me to accomplish this?

There are still some new members who keep posting that the bill S 1348 looks very good and it has SKIL provisions etc, because they get pointed to the last year's bill.
If you go on thomas.loc.gov and find bill text for S. 1348 you see a bill that is a copy-paste version of LAST YEAR'S SENATE BILL S. 2611.
That text is last years text that was initially put in place as a place-holder BEFORE the grand compromise was reached.
After the grand bargin (compromise/coalition) was reached, the text of the grand compromise replaced the entire text of last year's bill (that has SKIL) was the next text.
Amendment # 1150 (S.A. 1150) Sponsored by Sen. Kennedy is a 400 page amendment that replaces the entire text that was intially in the bill with the new text. Its a "Substitute" amendment.
Read the S. A. 1150 text. Its also on IV homepage as PDF. That is the bill now. Here is the link to that

What I'd do is:
Ctrl+click the channel (loads selection)
then go to the layers, and select the layer you want to apply the selection, then press Alt+backspace to fill the selection.
Then ctrl+D to unload selection...

My company uses Cheryl-Lenz Calvo. They took long time to apply for the labor certification part of the greencard process, but otherwise they are very professional, and I would recommend this firm.
does anyone know of any good chicago based immigration lawyer?

I actually went for stamping in my 4th year, that's after extending my H1 after the first 3 years. They didn't ask any questions. I'm not from India though so I don't know whether its different.

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

I'm a mechanical engineering and also have an MBA degree.
I work as a support engineer.
My lawyers tell me that I cannot apply in EB2, since my Post grad degree is unrelated to my grad degree and so does not apply to my job.
Is this true?
Can I not file in EB2?

your site is not a good intro for business.
"home", "about" and "services" all link back to index, no content, no details about who is behind this, the examples provided in "portfolio" are not even clickable, and worst, the mail link doesn't work from index.html as it's misconfigured (emailto instead of mailto..), only from the portfolio page, but on this page, the link on the portfolio menu is wrong,
basically, you better hurry and get that site done if you're looking for jobs...
Nice logos, what's pricing?
;)

Hi,
I am currently on H1B with an employer who has processed GC so far (labor and 140 are approved)
Currently I have all documents except
1)Approved 140
2) Employement offer letter
For 140, I have courtesy copy.
Employer is asking lot of money to file 485 all of a sudden. And they are not responding to my calls for offer letter.
So I was planning to apply 485 by myself or hire an attorney other than my company's.
Since I dont have above mentioned documents, can I still apply 485 without being denied?
Please help me

Will the core team be sharing their strategy for 2007 with the members?
I don't think core is going to spill it's strategy on the forum for world to see. I would suggest you to join local chapter to know how things will be performed. :)

There is no way that she can start working from April. If her H1B is approved, the earliest she can start working will be Oct 1, 2007. Also, make sure that her H1B is filed ASAP because the 20,000 MS quota has also been seen to evaporate pretty quickly (~1-2 months).
In other words, she will have to convince her employer to allow her to start from October.

I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.
This is what politicians do, be it the US or India or any place on earth. BHO is one of them, isnt he?

Hi,
I am currently residing in US on H-4 visa. My husband is on H-1 visa and our Green Card processing is in progress - our
I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?
Thanks,
BS
