Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.

Hello IV members,
I have been watching IV forum during the last four weeks. I feel it is a great place to post questions and comments to help everybody in our long Immigration journey. I have a situation here.
I have filed my H-1B extension, my wife�s H-4 extension, my I-140 and our I-485 applications recently from my current address. I haven�t got the approvals yet for any of them. I am thinking of taking another project(with the same employer of course) next month and relocating to a new state.
I heard that immigration documents don�t get forwarded by USPS. My worry is about my wife�s H-4 extension approval notice as other communications will go either to my employer or lawyer. I know that we have an online form to update our new address to USCIS.
Did anybody run into problems of mails being sent to the address in the forms even after you filled out this form?
Please let me know what you think about relocation after filing immigration papers.

Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

Hello,
If someone is going to be filing for I-140 on a recently approved EB2 (India) while on H1-B in USA with same employer, is it better to check the first box (Alien will apply for visa at a consulate abroad - meaning consular processing of 485) instead of AOS? My understanding is once I-140 is approved and if 485 dates become current, then if CP has been indicated on I-140, then the consulate abroad will order visa number in the month after and the person should get an interview call, even if the dates retrogress back in the following months?
In that case indicating CP is better than AOS on I-140? If so, can the person continue to work on H-1 while waiting for the interview call at consulate abroad?
Thoughts appreciated. Anyone please?

Hi,
I have worked in the US for 3 months (april, may and june) on H1b visa and still haven't got my pay stubs. Recently I came to India for my marriage and after marriage, I want to go to US on L2 visa (my fiance is on L1 visa). While trying to go to US on L2 visa, will I be asked to produce my previous pay stubs? Also when I asked my employer to give my pay stubs he said he had lost them and said instead of pay stubs I can have W2 which will be the proof that I have worked. Will the W2 be enough or I need the pay stubs? Please someone clarify my doubts.

Does anyone know if you can file for I-485 on a B1/B2 or do you need to have an H4 status?
It seems to me, you are on a B1/B2 and are contemplating a marriage to a "485 current" green card benfeciary...and subsequently filing the 485 jointly with your would be other half...
The intention in a B class visa is very weak and its purpose very limited. It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Any change of status from a B class visa is usually looked upon with a frown by the USCIS...
Even if you are not contemplating a marriage, but are already married for long but just happen to be in the US on a B Class visa, it is best to reliquish your B status, before doing anyting...

Thanks for your reply. In this specific skills or requirements, we also listed several tools, I let my former employer listed them in their experience letter. Other than that, I really don't how to proof them.
on 2nd req, my opinion would be to submit following related to ur skills.
- certifications earned from industry recognised bodies like PMP or OCP etc.

For your condition, I believe for #15 is AOS pending .. you will lose your H1/H4 status when you entered using AP.
not sure about #14, I think it's PAROLEE.

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Hi, This is my first time here. I have been hearing a lot about H1-extensions facing challenges. One of my friends, who is a consultant has got his H1-extended only for a the next 6 months. I understood from him that his client manager was called and asked how long his project will last and since the answer was, "6 months as of now, and longer if the market picks up", he was given the extn for 6 months. Another friend of mine who works full-time in a technology company has got his H1 extended for 3 years. My question: Has any of you(if you are a consultant) got your visa extended for 3 years, or do you know of a consultant who has got his visa extended for 3 years in the last few months. I know, that consultants face a lot of scrutiny, but wanted to confirm if for all of them, the extensions are limited.
